In California, the property tax bill is secured, and often a secured property tax bill has a number of different charges. When the tax season comes, it’s easy to take all of it off of your federal Schedule A. But not all of the charges listed on a county property tax bill are considered a real property tax.

Failing to claim eligible assessments can result in IRS adjustments, an increased tax bill, and interest and penalties. Homeowners need to know the difference between value-based property taxes and local service charges to avoid costly filing mistakes. Look for a tax professional (like a Los Angeles IRS tax attorney) who can guide you properly.

Your Entire Property Tax Bill May Not Be Deductible

In general, federal tax law permits a homeowner to claim a deduction for state and local real property taxes paid in the tax year, subject to any limitations. But taxes levied for local benefits or services are not necessarily included as real property taxes.

California property tax bills often include multiple taxes:

  • Ad valorem property taxes: Property taxes paid on the assessed value of the property, usually based on the formula in Proposition 13 of California.
  • Special taxes used to pay for infrastructure and public facilities in community facilities districts (CFDs) known as Mello-Roos assessments. Their deductibility will be dependent on their legal nature and on federal rules.
  • Sewer and sanitation charges: Fees for services generally are not deductible as real property taxes. You must hire experts (like a lawyer for tax return), those who can understand your problem and work around it.
  • Some charges are for public improvements or for specific benefits as opposed to general government services, such as school and local assessments. The treatment may vary with the structure or purpose of the assessment.
  • Direct benefit assessments: Assessment of charges for improvements affecting a specific property can be nondeductible as current taxes, but may be a capital cost that would impact the basis of the property.

The key difference is not that it’s on a county tax bill at all. The federal tax treatment for it is determined by its legal nature and use.

Find the Correct Answer for Your Deduction

Please take these steps prior to filing:

  • Get full county tax bill and payment records.
  • Reconcile general property taxes and direct assessments and service fees.
  • Request clarification from the county tax collector or district on unclear charges.
  • Subtract amounts actually paid during the tax year for any qualified amounts.
  • Use the federal state and local tax (SALT) deduction cap. The general limit for 2025 is $40,000, less income-related reductions and other limits

Keep in mind the IRS is responsible for the federal Schedule A deduction. FTB does California taxes separately, so don’t assume that a federal deduction will be exactly the same on your California tax return. Discussing your issue with experts is the right way to deal with payroll late payment penalty.

The Following Are Tips to Avoid Costly Filing Errors:

  1. Store the property tax bills, receipts, and assessment statements with your tax records.
  2. Don’t assume that all the charges marked “tax” can be deducted.
  3. Review whether a capital improvement may be added to the property’s cost basis.
  4. If your bill has a significant number of special assessments or if you need to make any complex adjustments to your federal or state returns, please consult a professional.

Taking an unallocated California property tax refund without knowing the details of those taxes can cause the federal tax return to be wrong. Identify eligible taxes and exclude the fees that aren’t deductible; make sure to apply the right deduction limits to preserve your tax position.
